The Patient Safety Group Inc. is a Massachusetts corporation (the “The Patient Safety Group”) that owns and operates an Internet site that provides education, information, and data resources to its users in an effort to improve health care (the “PSG Site”). The PSG Site is intended to support entire health care organizations including, physicians, nurses, clinicians, managers, executives, policy-makers and educators.

You also understand and agree that we cannot and do not warrant or guarantee that files available for downloading through the website will be free of infections or viruses, worms, Trojan horses or other code that contains contaminating or destructive properties. You understand and agree that you are solely responsible for implementing sufficient precautions, procedures and checkpoints to satisfy your own requirements for the accuracy of data input and output, and for maintaining a means external to the PSG Site for the reconstruction of any lost data. We do not assume the responsibility for the loss of any information, data, or other materials resulting from your use of the PSG Site.
Although we are selective about the organizations we link to, we do not assume any responsibility for any websites that are linked to our site or that you browse to after following a link from the PSG Site.

THE PSG SITE DOES NOT ACCEPT ANY PATIENT SPECIFIC INFORMATION, INCLUDING NAMES, DATES, OR INFORMATION THAT CAN BE TRACED BACK TO A SPECIFIC PATIENT. We reserve the right to remove any such content at any time without your consent.
In addition, you may not post any messages, links or code that would be misleading, false, vulgar, inappropriate, or harmful. We reserve the right to remove any such content at any time without your consent.
We are very cognizant of privacy issues. The success of the programs within the PSG Site is contingent on the comfort that our users feel with respect to their privacy. You should exercise caution when deciding to disclose any sensitive information on the PSG Site. Never identify a patient.
This agreement shall be governed in all respects by the laws of the Commonwealth of Massachusetts without giving effect to its conflict of law provisions. Both you and The Patient Safety Group submit to personal jurisdiction by and venue in the state and federal courts in the Commonwealth of Massachusetts, Suffolk County, and further agree that any cause of action arising under this agreement shall be brought in such venue. If any provision of this agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. Headings are for reference purposes only and in no way define, limit, construe, or describe the scope or extent of such section. The Patient Safety Group's failure to act with respect to a breach by you or others does not waive its right to act with respect to subsequent or similar breaches. This agreement and the terms and conditions contained herein set forth the entire understanding and agreement between The Patient Safety Group and you with respect to the subject matter hereof and supersede any prior or contemporaneous understanding, whether written or oral.
